By using Rightso, you agree to the following terms and conditions (the "Terms of Use" or "Agreement"):

  1. What is Rightso: as requestor you can generate a request and send it to an organization. As an organization, you can generate a response or action letter. If the request was generated using the generator, the request includes a key that the organization can use to import the request's data into the generator. To be clear, by a "request" we mean a GDPR request that is supported by Rightso. For the supported GDPR requests, please refer to Rightso.

  2. No abuse: you may only use the generator for legitimate purposes. The purpose of this generator is to make life easier for requesters and organizations. We rely on you not to abuse this generator, e.g. by sending multiple requests intended to cause nuisance. We reserve the right to block access to the generator to users who violate the terms of use or applicable regulations, or who use the generator in a way that is defamatory, harmful, annoying, offensive or otherwise inappropriate for others.

  3. Completely free: the use is completely free but at your own risk. Neither Timelex nor any service provider accepts any liability for any damage you may suffer as a result of using this generator. Furthermore, Timelex does not guarantee that this generator will always be 100% available. We may decide to suspend or terminate the use of this generator at any time.

  4. No legal advice: We do not provide legal advice through this generator. As we do not know your identity, you will not become a Timelex client by simply using the generator. If you are looking for legal advice as an applicant or organization, we recommend that you contact us. The generator or its result cannot bind Timelex in any way.

  5. No guarantee: We do not guarantee that the generated document is 100% error free. The result depends on your answers and we advise you to read the result carefully before using or sending it. If you do find any errors, please send them to info@timelex.eu so we can fix them. If you contact us, we will treat your data confidentially.

  6. Your privacy is important: it goes without saying that this generator respects your privacy. Through our privacy policy for the use of Rightso, we explain to you as clearly and transparently as possible which personal data is being processed and why. If you have any questions about your privacy, please contact privacy@timelex.eu.

  7. Encryption of your answers: as soon as you export a document, your answers are immediately encrypted (for those with a technical interest, AES-128 encryption is used). This means that neither Timelex nor ClauseBase have access to your answers (even if we wanted to). Only the person who still has a copy of the document containing the key can read your answers. We will not and cannot use your data for other purposes than offering you the generator.

  8. Deletion of your answers after 3 months: your encrypted answers will only be kept for three months. This period starts on the day you generated the document. The organization to which you send your request will be able to import your answers using your key during this period. After three months your encrypted personal data will be irrevocably deleted. So be sure to make your own copy if you want to keep your data longer.

  9. Intellectual property: the technology used by Timelex remains the sole property of our service provider ClauseBase. The content of Rightso (e.g. the questions and the generated document) is protected by intellectual property rights which belong exclusively to Timelex. By using Rightso, Timelex grants you a revocable and non-exclusive right to use Rightso for personal purposes in accordance with these terms of use. If you represent an organization, we understand personal purpose as using Rightso to respond to a data subject's request, but without further marketing Rightso. For the avoidance of doubt, there is no transfer of intellectual property rights, in whole or in part, and you are not authorised to distribute, commercialise, sell or rent, make available or otherwise reproduce the technology of ClauseBase or the content of Rightso. If your data or uploaded content are protected by an intellectual property right, you grant Timelex, our service provider ClauseBase and any third party to whom you send a request or an answer to a request, free and worldwide right to use all data and this content in accordance with these terms of use for the provision of the service. In any case, you guarantee Timelex that this data or content does not infringe any intellectual property rights of third parties. The term intellectual property rights in this clause means the following: all (trade) marks, logos, service marks, domain names, drawings, models, patents, copyrights (including all rights relating to software) and moral rights, rights relating to databases, software, know-how and other rights, as well as all other industrial and intellectual rights, in each case regardless of whether they are registered or not and including the applications for registration, as well as all equivalent rights or means of protection leading to a similar result anywhere in the world.

  10. Additional information for consumers: Rightso is offered by Timelex CVBV, rue Joseph Stevens 7, 1000 Brussels, VAT BE 0890.217.005, RPR Brussels (telephone number: +32 2 893 20 95). The agreement is concluded in English. The consumer is responsible for the preservation and archiving of this agreement. You have the right to withdraw from this agreement within 14 days after the day following acceptance of these terms of use. You can do so by contacting us at info@timelex.eu.

  11. Other stipulations: Timelex may transfer or outsource its rights or obligations under these Terms of Use to third parties without requiring your consent and without giving rise to any damages. The nullity or invalidity of all or part of a provision of these terms of use shall not affect the applicability of the remaining provisions. The provision in dispute shall be deemed to be independent. Timelex is entitled to replace the provision with a valid provision with a similar purpose. The use of (sub)titles in these terms and conditions of use is purely illustrative.

  12. Logging: Timelex and our service provider ClauseBase log access to Rightso for security reasons. We maintain an updated log for this purpose. To the extent permissible under applicable law, you agree that this log is evidence that Rightso has been accessed and used in a particular way, unless there is evidence to the contrary.

  13. Applicable law and competent court: These terms of use shall be exclusively governed and interpreted in accordance with Belgian law. In the event of a dispute about these terms and conditions of use, Timelex will endeavour to resolve the dispute by mutual consultation. If this is not possible, disputes shall be settled by the Dutch-speaking courts in Brussels in accordance with Belgian law, without prejudice to mandatory legal provisions.
